NOTICE TO CREDITORS

Having qualified as executor of the estate of Arch Boyd Browning, deceased, late of Washington County, North Carolina. This is to notify all persons having claims against said estate to exhibit them to the undersigned at the address shown below, on or before January 5, 2027 or this notice will be pleaded in bar of their recovery. All persons indebted to said estate will please make immediate payment.

Under and by virtue of the power of sale contained in a certain Deed of Trust made by Susan Clifton Spruill and Kenneth Edwin Spruill (Deceased) (PRESENT RECORD OWNER(S): Kenneth Edwin Spruill) to Karina M. Becker, Trustee(s), dated March 24, 2010, and recorded in Book No. 464, at Page 841 in Washington County Registry, North Carolina, default having been made in the payment of the promissory note secured by the said Deed of Trust and the undersigned, Substitute Trustee Services, Inc. having been substituted as Trustee in said Deed of Trust by an instrument duly recorded in the Office of the Register of Deeds Washington County, North Carolina and the holder of the note evidencing said indebtedness having directed that the Deed of Trust be foreclosed, the undersigned Substitute Trustee will offer for sale at the courthouse door in Plymouth, Washington County, North Carolina, or the customary location designated for foreclosure sales, at 10:30 AM on October 19, 2026 and will sell to the highest bidder for cash the following real estate situated in Roper in the County of Washington, North Carolina, and being more particularly described as follows:

All that certain lots, tracts or parcels of land lying and being in Washington County North Carolina, and more GET purchasing the property. on the North side of the said Mason Ditch and reference is hereby especially made to the said deeds of record in the Office of the Register of Deeds of Washington County. North Carolina, for purposes of complete description of said land. Tax ID: 5825/5826. Together with improvements located thereon; said property being located at 341 Crystal Lane, Roper, North Carolina. Being the same fee simple property conveyed by deed from estate of Elbert D. Spruill deceased and estate of Beedie a. Spruill. Deceased wife to Kenneth Edwin Spruill, dated 06/23/1981 recorded on 07/02/1981 in book 283. Page 627 in Washington county records, state of NC. The property also conveyed by general warranty deed from Elbert D. Spruill and Biddie A. Spruill wife to Kenneth Edwin Spruill dated 09/06/1978 recorded on 09/27/1978 in book 269 page 542. Trustee may, in the Trustee’s sole discretion, delay the sale for up to three hours as provided in N.C.G.S. §45 21.23. particularly described as follows: Tract No.3: beginning in a black gum a corner tree of M.P.Gethro, deceased. Running northwardly to the swamp called Chesson Swamp, thence down the various courses of said swamp to Jesse Sawyers corner: thence southwardly along Jesse Sawyers line to M.P.Gethro line; thence eastwardly along M.P.Gethros line to Emanuel Collins line; thence along Emanuel Collins line to the heirs of M.P.Gethro heirs, being 38 acres, more or less, it being the Bailey Biggs tract of land. Being that same land as described in Deed from Maud Biggs to D.E.Spruill. Dated December 14. 1922. Recorded in Book 82, Page 174, Washington County Registry. The foregoing tract No.3 is the same as the first tract or parcel of land described in the Deed dated August 7. 1970, from Duard E. Spruill to Elbert D. Spruill and wife, Biddie A. Spruill. Of record in Book 228, Page 81, Washington County Public Registry.

And all that certain lot or parcel of land situated in Skinnersville Township, Washington County, North Carolina and more particularly described as follows: it being a certain parcel of land well known in the community as the Knoll it being all of that part of the land conveyed to the said Carney Spruill by Deeds from Annette Biggs and E.R.Spruill Mortgagee. Lying on the North side of the Mason Ditch. Containing 30 acres, more or less. It is the intention and purpose of this Deed to convey all that part of the tract of land aforesaid lying Should the property be purchased by a third party, that party must pay the excise tax, as well as the court costs of Forty-Five Cents ($0.45) per One Hundred Dollars ($100.00) required by N.C.G.S. §7A-308(a)(1), and agrees to pay the one percent (1%) grantors tax levied by Washington County.

Should the property be purchased by a third party, 31 CFR 1031.320 requires certain qualifying residential real estate transactions to be reported to the federal government. If you are the successful bidder in this proceeding, you may be required to provide all applicable identifying information about yourself and, if applicable, any entity or trust The property to be offered pursuant to this notice of sale is being offered for sale, transfer and conveyance “AS IS, WHERE IS.” Neither the Trustee nor the holder of the note secured by the deed of trust/security agreement, or both, being foreclosed, nor the officers, directors, attorneys, employees, agents or authorized representative of either the Trustee or the holder of the note make any representation or warranty relating to the title or any physical, environmental, health or safety conditions existing in, on, at or relating to the property being offered for sale, and any and all responsibilities or liabilities arising out of or in any way relating to any such condition are expressly disclaimed. Also, this property is being sold subject to all taxes, special assessments, and prior liens or prior encumbrances of record and any recorded releases. Said property is also being sold subject to applicable Federal and State laws. A deposit of five percent (5%) of the purchase price, or seven hundred fifty dollars ($750.00), whichever is greater, is required and must be tendered in the form of certified funds at the time of the sale. If the trustee is unable to convey title to this property for any reason, the sole remedy of the purchaser is the return of the deposit. Reasons of such inability to convey include, but are not limited to, the filing of a bankruptcy petition prior to the confirmation of the sale and reinstatement of the loan without the knowledge of the trustee. If the validity of the sale is challenged by any party, the trustee, in its sole discretion, if it believes the challenge to have merit, may local request the court to declare the sale to be void and return the deposit.

The purchaser will have no further remedy. Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may after receiving the notice of foreclosure sale, terminate the rental agreement by providing written notice of termination to the landlord, to be effective on a date stated in the notice that is at least 10 days but not more than 90 days, after the sale date contained in this notice of sale, provided that the mortgagor has not cured the default at the time the tenant provides the notice of termination. Upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination.
