- Petitioner and Respondents own interests in the parcel of real property described as Lot 5 on the Plat Map recorded in Map Book 7, Page 94, of the Washington County Public Registry, which is part of that tract of land title to which was registered under Chapter 43 of the General Statutes as Registered Estate No. 578 and is more particularly described on Exhibit 1 attached hereto and incorporated herein by reference (the "Property").
- On or about June 16, 1994, the Property was transferred by Furbee Farming Corporation to Logan N. Womble, III, and wife, Millie Womble, Ed Womble, and wife, Wally Womble, and Nyal W. Watson, and husband, Larry Watson, in fee simple.
- On or about October 23, 1997, Petitioner and Wallace Lamb divorced, thus severing the tenancy by the entirety and rendering Petitioner and Wallace Lamb tenants in common.
- Logan N. Womble, III, Nyal Watson, and Larry Irving Watson have since passed away.
- Logan N. Womble, Ill's interest passed to his wife, Millie Womble, as the surviving tenant by the entireties. Upon Nyal Watson's death, her interest passed to Larry Irving Watson as the surviving tenant by the entireties, and upon Larry Irving Watson's death, pursuant to Item III of his Last Will and Testament, devised to the Watson Family Trust.
- There are no encumbrances on the Property except the following:
- 2025 and subsequent years Washington County taxes.
- A fifty (50) foot right of way as reserved by Furbee Farming Corporation on the Certificate of Title recorded in Torrens Book 18, Page 118, of the Washington County Public Registry.
- A Conservation Easement granted m favor of the Department of Environment and Natural Resources, State of North Carolina, recorded at Deed Book 415, Page 218, of the Washington County Public Registry.
